Hayward  Digital Sweepstakes (“Sweepstakes”)
Official Rules

           

  1. No purchase or payment of any kind is necessary. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS PROMOTION IS INTENDED FOR PLAY IN THE U.S. ONLY AND WILL BE GOVERNED BY U.S. LAW. Promotion begins at 2:00:01 EDT on 9/25/14 and ends at 11:59:59 EDT on 10/25/14. Open to legal residents of the 50 United States and Washington D.C., 18 years of age or older (19 in Alabama and Nebraska). Employees of Hayward Pool Products (“Sponsor”), its affiliates, subsidiaries, distributors, sales reps, advertising and promotion agencies and suppliers of promotion materials, and the members of the immediate families and households of each are not eligible. Void where prohibited.

  2.   THERE ARE TWO WAYS TO ENTER SWEEPSTAKES:  (i) go online to the Hayward Pool Products Google+ page (http://bit.ly/HaywardPool) and click on the link to the “Sweepstakes” tab to access the Sweepstakes entry form.  Feel free to 'Follow' our Hayward Page before heading over to the Sweepstakes entry form OR (ii) Go to Hayward.com/sweepstake and follow the online instructions for entry.  Limit one entry per person per 24 hour period

  3. Automated online entries are prohibited.  Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process.  By entering, participant agrees to abide by and be bound by these rules and decisions of Promotional Alliance, Inc., an independent judging firm whose decisions are final and binding in all respects. In the event of a dispute regarding the identity of the online entrant, any online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry, provided that person meets all eligibility requirements set forth in these Official Rules. “Authorized Account Holder” means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entrants may not participate with multiple email addresses or under multiple identities, nor may entrants use any device or artifice to enter or to enter more than once per 24 hour period during the Sweepstakes or as multiple entrants. Any entrant who attempts to enter with multiple email addresses, under multiple identities or uses any other device or artifice to enter multiple times will be disqualified from participation in the Sweepstakes and all entries submitted by that entrant will be void.  Entrants must have a valid email address.  Sponsor reserves the right, in its sole discretion to cancel or suspend this Sweepstakes should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the game.  In the event of cancellation, Sponsor will randomly award the prizes from among all eligible, non-suspect entries received prior to cancellation.  Please see the privacy policy located at www.hayward.com for details of Sponsor's policy regarding the use of personal information collected in connection with this Sweepstakes.  If you are selected as the winner, your information may also be included in a publicly-available winner’s list.  Entries become property of sponsor and will not be returned.

  4. Prize: One (1) Grand Prize. Kindle Reader Wi-Fi, 6" Display.  Approximate Retail Value is $69.00.

  5. Total approximate retail value of Prize is $69.00 Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize. Winner will be determined in a random drawing on or about 10/31/14 from among all eligible entries received. Odds of winning are dependent on the number of eligible entries received from both entry methods combined. 

  6. Prize winner will be notified by email or regular or certified mail on or about 11/11/14. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.  Prize winner will be required to sign an affidavit of eligibility and release of liability/publicity (where permitted) within 21 days of the date on the notification letter or the prize may be forfeited and awarded to an alternate winner.  If any prize or prize notification letter is returned as undeliverable, the prize may be forfeited and awarded to an alternate winner.   

  7. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Prizes are nontransferable, and not redeemable for cash. No prize substitutions allowed except by Sponsor, who may substitute a prize of equal or greater value if the advertised prize becomes unavailable. All taxes on prizes are the sole responsibility of the winner.

  8. By entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor, Promotional Alliance, Inc.,  Google and their respective parent companies, affiliates, subsidiaries, distributors, sales reps, advertising/promotion agencies and suppliers of promotion materials, and the employees, contract workers, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses or damages to any person (including but not limited to the risks of travel and/or death) and to property of any kind caused in whole or in part, directly or indirectly, by participation in the Sweepstakes or the acceptance of a prize or participation in any prize-related activities or any travel related thereto (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. 

  9. By accepting a prize, the winner agrees to the use of his/her name, photograph, likeness and/or statements made by the winner regarding the sweepstakes and Hayward Pool Products for advertising, publicity and promotional purposes in the U.S. without limitation and without further compensation, except where prohibited.

  10. For the name of the winner, send a self-addressed, stamped envelope to: Hayward Pool Products Digital Sweepstakes Winners List, c/o Promotional Alliance, Inc., 2303 Wycliff Street, 1st Floor West, St. Paul, MN 55114. Requests must be received by 11/16/14.

  11. GOVERNING LAW: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the sweepstakes shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of laws rules.  By entering, entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Union County, New Jersey.

 

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Google. You understand that you are providing your information to Sponsor and not to Google. The information you provide will only be used as provided in Sponsor's privacy policy, located at www.hayward.com.  Any questions, comments or complaints regarding this Promotion shall be directed to Sponsor and not to Google.
